REGULATIONS on membership

of Women with Disabilities SHYRAK Public Association

The present Regulations are adopted in accordance with Law N 3-I (31 May 1996) of the Republic of Kazakhstan "On public associations" and the Charter of Association of Women with Disabilities SHYRAK Public Association (hereinafter "the PA") and define the terms and procedures for admission of new members to the PA, terms and procedures for termination of membership of the PA, and procedures for voluntary withdrawal from the PA.

1. General Provision

  • Citizens of the Republic of Kazakhstan and foreign citizens who have reached 18 years of age and over and share the objects of the PA as provided under its Charter may become members of the PA.
  • The following types of membership are available within the PA:
    • Active members of the PA;
    • Honorable members of the PA.
  • Membership of the PA is voluntary and is expressed through participation in the activities of the PA. New members are admitted to the PA \on the basis of an application made in writing to the Board of the PA.
  • Members of the PA have equal rights and bear equal responsibilities.
  • Rights of members of the PA may not be transferred to third parties.
  • The PA carries out registration of members and keeps a single register of members of the PA.
  • The keeper of the register of members of the PA is the Executive Body of the PA.

2. Terms and procedures for admission of members of the PA

  • Decisions on admission of new members of the PA or refusal of admission are taken by the Executive Body of the PA.
  • To become a member of the PA an applicant submits a set of documents (Appendix 1) to the Executive Body of the PA.
  • Deputy Chair on Membership introduces the applicant at a meeting of the Executive Body of the PA which is the closest in time following the submission of the set of documents.
  • Natural persons wishing to acquire membership of the PA are to present the following documents:
    • Application in a standard form (Appendix 2);
    • Copy of the document confirming payment of an annual membership fee.
  • Upon the receipt of the set of documents, the documents are assigned incoming correspondence numbers and dates of receipt thereof are noted. A personal file is opened for the applicant, which is kept at the office of the PA.
  • Once the member is granted a registration number in the single register of the PA (identical to the number shown on the membership card), this number is to be indicated and required on all forms of documents containing information about the members of the PA and about the contents and circulation of their records. Documents not indicating the registration number of the member of the PA or stating it incorrectly are not considered and are returned to the sender.
  • Changes in contact information and other information regarding members of the PA are entered into personal files and the single register of the PA with the dates of such entries being noted.
  • The decision of the Executive Body refusing membership of the PA is communicated in writing to the applicant within 30 days of the date on which the decision was made. The membership fee in this case is to be refunded upon his written application.
  • Members of the PA receive membership cards in the established form (Appendix 3).
  • As a replacement of the lost membership card a duplicate may be issued upon the application of the member of the PA. A fee is collected for the issuance of a duplicate in the amount equivalent to the costs of production and documentation of the same.
  • The Executive Body of the PA is authorized to admit as Honorable Members of the PA natural persons who have made a significant contribution to the attainment of objects and aims of the PA.
  • Honorable Members of the PA have advisory votes at general meetings of members.

3. Procedure and timeframe for contributing membership fees to the PA

  • The PA has annual membership fees as well as special purpose membership fees.
  • The first annual membership fee is paid at the time of submission of a set of documents for admission to the PA.
  • Annual membership fees are to be paid until the 31st of March each year.
  • The term of coverage of the annual membership fee is 12 months since the respective payment is made.
  • The amount of the annual and special purpose membership fees as well as changes relating to the procedure for payment thereof are set by the Executive Body of the PA.
  • Honorable Members of the PA who have made a significant contribution to the attainment of objects and aims of the PA may be exempt from payment of the annual membership fee upon the decision of the Executive Body.
  • Each member of the PA has the right to render additional financial assistance to the PA at any time and without limitation.
  • The Review Committee checks that fees are accurately paid, accounted for and properly expended.
  • Payments of regular membership fees are recorded in the financial registers (Appendix 4), which are kept on file at the office of the PA within three years.
  • Membership fees are used for the attainment of objects of the PA under its Charter and for charitable purposes.
  • Decisions on how membership fees are used are made by the Executive Body.
  • The collections of fees received over the year are considered at general meetings and meetings of the Executive Body of the PA.

4. Rights and obligations of members of the PA

Members of the PA have the right to :

  • Elect and be elected to the management bodies of the PA;
  • Make proposals for amendments to the Charter;
  • Propose initiatives and ideas on the activities of the PA;
  • Receive information on the activities of the PA;
  • Manifest their membership of the PA;
  • Members of the PA have the right to receive material charitable support in accordance with the procedure and in the amount determined by the Executive Body.

Members of the PA have the obligation to:

  • Promote the attainment of the objects of the PA under the Charter;
  • Comply with the provisions of the Charter;
  • Refrain from causing material and moral damages to the interests of the PA;
  • Pay membership fees regularly

Members of the PA hold no rights in relation to the property passed by them to the PA, including voluntary contributions. They hold no liability for obligations of the PA and the PA holds no liability for obligations of its members.

Members of the PA may voluntarily withdraw from the PA having communicated their decision in writing to the Board of the PA.

5. Terms and procedures for termination of membership of the PA

  • Voluntary termination of membership is made by submitting a written application to the Executive Body of the PA. Deputy Chair on Membership is to pass the said application to the Executive Body.
  • Membership of the PA can be terminated upon the decision of the Executive Body of the PA by excluding members of the PA in the following cases:
    • Systematic failure to pay annual membership fees;
    • Infliction of considerable material and moral harm to the interests of the PA;
    • Death of the member.
  • A member is considered excluded from the PA following the adoption by the Executive Body of the PA of the decision on exclusion of the member and entry of relevant records into the single register of members of the PA.
  • A member excluded from the PA at the motion of the Executive Body of the PA is to be informed of the relevant decision and the reasons underlying the same within 30 days of the adoption of the decision.
  • Membership fees are not refunded upon termination of membership of the PA but are used for the attainment of the objects and aims of the PA under the Charter.
  • A excluded member of the PA may acquire membership of the PA again on genera grounds established under the present Regulations and the Charter of the PA.
  • 6. Concluding provisions

    • The present Regulations come into force immediately following the approval thereof by the Executive Body of the PA.
    • Amendments to the present Regulations are made on the basis of appropriate decisions of the Executive Body of the PA.
